Product Liability (Machine Accidents)

Manufacturers have a responsibility to design and distribute products free from defects, but when a product is potentially hazardous due to improper manufacturing techniques, damage in distribution, or lacks instructions for correct use, you may be able to file for a product liability claim.

Choosing to purchase a product in New Jersey should not typically require you to make determinations on the safety of that item. That’s why product liability laws are in place. If you or a loved one has been injured by a defective product you may be eligible for compensation.

Products we use every day, such as power tools, kitchen appliances, industrial machines, or medications can all cause serious harm if the manufacturer does not take the proper precautions to prevent it. Dangerous machinery should have guards, paint should be non-toxic and lead-free, and choking hazards on toys for small children eliminated. If an inherently dangerous product cannot be properly guarded, the manufacturer has an obligation to provide clear instructions and warnings as to its use.

Employers also have a duty to not intentionally use harmful products and to provide protection for their employees when necessary. If you are injured on the job and receive workers’ comp benefits through your employers insurance, you may still be eligible for compensation from the manufacturer.
